1. Scope of Work
JTGS will carry out the work described in the accepted estimate to the standard reasonably expected of a professional gardening service.
The Client must clearly identify property boundaries and any underground services such as cables, pipes, drains, irrigation systems, or similar hazards.
JTGS accepts no responsibility for damage to underground services or boundary disputes where such information has not been provided in writing prior to work commencing.
JTGS reserves the right to amend or withdraw any estimate prior to work commencing.
2. Estimates and Variations
All estimates are valid for 30 days from the date of issue.
The estimate is based on site conditions observed during the initial inspection. Any additional work, materials, or labour not listed in the estimate will be treated as a variation and charged separately.
If unforeseen issues arise during the Works, JTGS will notify the Client and agree any additional costs before continuing wherever reasonably possible.
3. Payment Terms
The Client agrees to pay JTGS the full contract value and any additional agreed costs.
One-off garden visits are payable upon completion of the Works.
For regular maintenance clients, payment is due on the day each scheduled visit is completed.
Where plants or materials must be purchased for a job, payment must be made at least 7 days before the agreed commencement date. If the start date is within 7 days, payment is required immediately.
For projects where labour costs exceed £1,000, JTGS may require a 50% deposit on the first day of work with the remaining balance payable upon completion.
If payment becomes more than 7 days overdue, JTGS reserves the right to charge interest at 8% above the Bank of England base rate and suspend future services until payment is received.
4. Cancellation and Rescheduling
The Client must provide at least 48 hours notice to cancel or reschedule a booking.
If cancellation occurs within 48 hours, JTGS reserves the right to charge a cancellation fee of up to 100% of the scheduled labour cost.
If JTGS arrives on site and cannot gain access, or the Client cancels upon arrival, JTGS reserves the right to charge the full labour cost for that visit.
JTGS reserves the right to postpone work due to unsafe weather conditions or circumstances beyond reasonable control.
5. Site Access and Responsibilities
The Client must provide safe and reasonable access to the Site.
The Client must provide access to water and electricity where reasonably required.
The Client is responsible for any parking permits, suspensions, or charges required during the Works. Any associated parking fees or penalties will be payable by the Client.
6. Materials and Plants
JTGS uses reputable suppliers for plants and garden materials. However, JTGS cannot guarantee plant survival after installation as ongoing care is outside JTGS’s control.
Plants are guaranteed only to have been healthy and of good quality at the time of supply unless otherwise agreed in writing.
The Client is responsible for watering and aftercare following completion of the Works.
7. Materials and Equipment on Site
Once materials are delivered to the Client’s property, the risk of loss, theft, or damage transfers to the Client.
Tools and equipment belonging to JTGS remain the property of JTGS at all times.
8. Garden Maintenance Services
Waste removal may incur an additional charge unless otherwise agreed.
If pet fouling is present in working areas, JTGS may issue a warning and reserve the right to charge a cleaning fee where repeated issues occur.
JTGS reserves the right to engage subcontractors where necessary to complete the Works.
9. Project Timing
JTGS will make reasonable efforts to start and complete work within estimated timeframes.
However, dates provided in quotations are estimates only and may change due to weather conditions, supplier delays, site conditions, or circumstances outside JTGS’s control.
10. Liability
JTGS will carry out all work with reasonable skill and care.
JTGS shall not be liable for indirect or consequential losses or for damage arising from circumstances outside JTGS’s control.
11. Maximum Liability
Where JTGS is found to be liable for loss or damage arising from the services provided, liability will not exceed the total value of the relevant services supplied under the contract.
12. Marketing and Photography
JTGS may take photographs of completed works for portfolio, marketing, or promotional purposes while respecting the Client’s privacy.
13. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
14. Insurance
Jonesy Thyme Gardening Services holds Public Liability Insurance.
15. Changes to Scope of Work
If the Client requests changes after accepting the estimate, JTGS reserves the right to adjust the price and completion timeframe accordingly.
16. Ownership of Materials Until Payment
All materials supplied by JTGS remain the property of JTGS until payment has been received in full.
17. Complaints Procedure
Any concerns regarding completed work should be raised within 7 days so JTGS can inspect and, where appropriate, rectify the issue.
18. Existing Property and Structures
JTGS shall not be liable for damage to existing structures or garden features that are defective, unstable, or deteriorated prior to the Works.
19. Boundaries and Neighbouring Property
The Client is responsible for ensuring that property boundaries are correctly identified prior to the Works.
20. Entire Agreement
These Terms and Conditions together with any accepted estimate constitute the entire agreement between JTGS and the Client.
21. Weather and Seasonal Conditions
JTGS reserves the right to reschedule visits where weather conditions make work unsafe or impractical.
22. Suspension of Services for Non‑Payment
JTGS reserves the right to suspend all future scheduled visits where invoices remain unpaid beyond the agreed payment period.
Acceptance
By accepting a quotation, estimate, or allowing JTGS to commence the Works, the Client confirms that they have read and accepted these Terms and Conditions.
